Renewal Date _____________ In addition to the above “Basic Terms”, the following terms and conditions are agreed to by the “parties”:1. Rental for the option terms set forth above shall be paid at the time of delivery of the instrument to “customer”2. “Lessor” grants to “customer” the right to purchase the instrument described in the Rental Contract providing “Customer” is not in default at any time during the term of Rental Agreement. The price to be paid shall be the retail price set forth above less rental payments paid, which shall be credited to the purchase price but, in no event, shall no more than two (2) years rental payments be credited to the purchase price.3. “Customer” forfeits any rent credit if the account is in default at any time during the term of the Rental Agreement.4. “Customer” may at any time during a rental period return the instrument but there shall be no refund for any unused portion of the rental.5. “Customer acknowledges having examined the instrument at the time of taking possession and accepts the same in “as is” condition and agrees to be responsible for maintaining the same in the same condition as at the time of delivery, reasonable wear and use accepted. Customer shall be responsible for any loss or damage to the instrument. Payment for any damage shall be due and payable within fifteen (15) days of submission by “Lessor” to “Customer” of an invoice or an estimate verifying the amount of damage and the cost to repair the same.6. Parties understand that unless “Customer” exercises the option to purchase and make sole payment for the instrument as hereinafter set forth, “Customer’s” possession of the instrument is in the capacity of a renter and legal title to the instrument remains in the name of Melk Music, Inc.7. In the event “Customer” desires to exercise the option to purchase set forth above, “Customer” shall do so by notifying “Lessor” in writing of intent to purchase accompanied by the full purchase price less limited rental credit as set forth above and upon receipt of full payment, “Lessor” will deliver a Bill of Sale transferring title to the instrument to “Customer”.8. “Customer” agrees to keep the rented instrument at the address set forth as the parent’s address below, except for occasional removal for purposes of use at musical functions, school, and related activities. In the event “Customer” changes physical addresses, “Customer” shall so notify “Lessor” in writing.9. In the event “Customer” files a petition in bankruptcy or becomes the subject of a receivership proceeding, “Customer” agrees to immediately return the instrument to “Lessor” and further to execute any and all documents which may be necessary to verify ownership of said instrument as being that of the “Lessor”.10. “Customer may renew this lease for an additional-like periods as set forth under the options above by delivering prior to the current rental term notice of intent to renew together with payment for the renewal. In the event the instrument is retained without renewal past the expiration of the rental period, or in the event any payment due hereunder is not made in a timely fashion, an initial late fee of $10.00 will be charged and then a late fee of $1.00 per week will be charged until the instrument is either returned or the rental payments made.11. The instrument described herein is being rented for the purpose of the family of the “Customer” and in the event the “Customer” whose signature appears below is married, the “Customer” acknowledges that the rental for a marital purpose and both husband and wife shall be jointly and severally responsible for all of the terms and conditions set forth herein.12. I agree to provide to “Lessor a credit card number and certify that the account whose number is provided will have sufficient credit to guarantee payment of future installments pursuant to the Rental agreement.13. I agree that in the event any payment due pursuant to the Rental agreement is made more than ten (10) business days after the due date, there shall be a ten dollar ($10.00) late charge assessed and I herby authorize Melk Music, Inc. to charge any delinquent payments after the ten (10) days referred to above against the credit card referred to in the previous paragraph and acknowledge that I have full authority to authorize such payments |
